The Demise of the 28-Clause Peace Proposal for Ukraine: How Diplomatic Efforts Continue to Falter

Europe breathed a deep collective sigh of relief on Monday, as the tension triggered by the introduction of a new comprehensive peace framework for ending the war appeared – briefly – to have been defused. A American diplomat spoke of "significant advancement" after diplomatic discussions in Geneva. On Monday night, the Kremlin made its response: a renewed assault of missile and drone strikes on Kyiv.

The Cycle of Negotiation and Warfare

The succession of opposing developments captured the bleak nature of the recent timeframe. By day, negotiation efforts are conducted: optimistic declarations are released from different nations. Considerable effort is devoted on restraining particular approaches. By night, the Kremlin brutally reminds the world that, for them, war remains the key method for achieving "settlement".

Nocturnal Warfare

As military strikes progressed into the early hours of Tuesday, the immediate reality of Ukraine's defenselessness was laid bare. Ukraine is able to track missile launches from enemy soil, a capability provided through up-to-date information. From witness perspectives, Ukrainian air force fighter jets that had been deployed to counter approaching cruise missiles streaked across the sky – advanced fighter aircraft delivered to Ukraine by European allies.

Shortly after, Kyiv's air-defence systems activated: defensive missiles targeted at a hostile projectile. This was a sophisticated defense system at work, probably delivered by partner states. Every deployment creates sudden vibrations, rattling buildings. The moment of terror quickly gives way to grim resignation: possibly the hostile projectile won't cause damage this time, sparing the city from devastation and another blackout.

Persistent Threats

Soon after, a large-caliber weapon fired at a unmanned aircraft in the vicinity, part of a rapid response unit – almost certainly allied-provided weaponry. Sadly, the bullets missed the opposing UAV – it continued its flight toward its objective.

Periodically, this persisted until dawn. Kyiv awoke to the daybreak reports: several casualties, damage and utility failures in multiple buildings as a result of the night's assault. As customarily, everyone still maintained normal activities – living the war. But those full day illustrated Ukraine's vital need on international aid – a need that neighboring countries are clearly incapable to substitute in the immediate future.

Failed Diplomacy

The comprehensive proposal from American leadership sparked intense emotion, controversy and profound anxiety – and briefly redirected concern from Ukraine's largest corruption scandal in years. Yet, we have seen this script before, after previous diplomatic encounters and multilateral gatherings.

Every new initiative from American administration unfolds according to the identical sequence: a diplomatic cavalry charge against Ukraine, which Kyiv, with other European capitals, succeeds in resisting. They contain the crisis but never actually achieve victory. This trend will, no doubt, persist.

Tactical Assessments

It is tempting to accuse certain parties of persistently promoting Russian terms. But that does not seem to be the entire situation. American leadership operates on a principle well known to seasoned negotiators: you cannot secure via talks what you have failed to defend militarily. The American government presumes that it is impossible to compel Moscow to relinquish the land that it presently holds in Ukraine's south or east.

The challenge is that while recognising this factual reality, US leadership does minimal to prevent Kremlin actions, through diplomacy or military means, from assuming that the current condition will not shift further in its advantage in the near future.

Opposing Positions

Therefore, the Kremlin is certain that the clock favors them – that Ukraine and its supporters are nearing depletion. Their incentive to sign a deal that does not give them the largest achievable advantage is virtually nonexistent. There may be numerous efforts to end hostilities, but they will persist as long as Russia's leader remains completely certain in the result.

On the contrary, Kyiv believes that Ukraine can still hold out, progressively conceding lives and land but preventing a total frontline collapse until circumstances change in its benefit.

Current Realities

Objectively, there are no real preconditions for a truce. Now, individual motivations are becoming relevant: political desires to negotiate peace and achieve global acclaim, and the government's double obstacles – on one hand, not to estrange crucial supporters, and on the other, to mobilize citizens around the flag against any plan Kyiv finds unacceptable, so that their priority does not move to internal issues. And although their task will now be significantly challenging after current events, it remains highly unlikely that this will change their overall approach.

These opposing factors are guiding negotiations.

Assessment and Future

It took a only one week to eliminate the suggested clauses of the latest plan. Assertive and inconsistent approach of the matter by American leadership, pushback by Ukraine and the rest of Europe, along with soothing efforts of representatives, and finally, recent disclosures, all did their job.

While new plans based on old ideas are imminent, Kyiv, London and other allied nations should arrive at a critical understanding: Ukraine and Europe will only be able to resist political attacks from Washington that are rooted in Kremlin requirements and show certain reluctance to change the course of events, if they remain united and strengthen their defence capabilities at a significantly accelerated rate. If they do, no combination of diplomatic or military actions will be able to break them. In the meantime, Ukraine's capability to repel nightly air assaults will, for the foreseeable future, primarily depend on continued Western support.
